Service Terms & Disclaimers

 

“The Company” – Kleendrainz Pty Ltd ATF Kleendrainz Business Trust t/as Poowee Plumbing Service & Poowee Drain Cleaning.

Kleendrainz Pty Ltd as trustee for the Kleendrainz Business Trust, also known by the trading names Poowee Plumbing Service & Poowee Drain Cleaning. “The Company” is a registered entity.  All Licensed and registered practitioners working for “The Company” are regulated by the Victorian Building Authority.  The word “Poowee” is a registered trademark and is exclusively owned by Kleendrainz Pty Ltd.

 

“The Company” guarantees that all plumbing services, will be carried out by licensed and/or registered practitioners with the Victorian Building Authority and all are required by law to adhere to the legislative requirements of the respective governing body.

 

Except for first scheduled appointments on any given day, “The Company” will offer a 2 hour window of arrival to allow for work or traffic delays from previous appointments.  

 

All promotional items with the Poowee logo shall only be used as promotional tools for its intended purpose and to promote the Poowee brand within the regulated industry in which it is registered with and can only be distributed by authorised business personnel.  All USBs, Discs and reports with the brand logos remain the property of “The Company” and shall only be distributed by authorised business personnel.

 

A report either with or without images may be supplied only upon request and prior notice and will be charged at an additional cost above the services rendered. All reports written and supplied by “The Company” are based on the professional opinion of the licensed practitioners, employed by “The Company” and licensed/registered with the Victorian Building Authority, following the visual inspection limited to areas and sections of any given property listed at the reference / site address, that were accessible and visible at the time and date of inspection. Such reports may or may not include dismantling or removing objects to enable identification for the requested purpose and may be supplied with recorded footage and/or photos upon request and prior notice.   “The Company” does not accept, nor bear, any liability for loss, damage or incorrect installation located at time of, or at any time, following such inspections.

 

All drainage inspection reports are an assessment of accessible sewer and / or storm water drains and pipes inspected at any given “reference / site” address listed.  Such reports are dated and written to acknowledge the status of drains and/or connections and points at the time of inspection only and may be supplied with recorded footage and/or photos upon request and prior notice, and as such will be charged at an additional cost above the services rendered.  “The Company” does not accept, nor bear, any liability for loss, damage, blockage, or incorrect installation located at time of, or at any time, following inspection.

 

All quotations provided by “The Company” include labour services and may or may not specify required or supplied materials and or/services including Compliance Certificates, associated fees and permits, rubbish removal and surface re-instatement. Upon acceptance of the provided quotation and the contractual commencement of any service/labour, any additional supply of materials and associated fittings, compliance certificates, fees or permits, rubbish removal or re-instatement of surface areas, which were not specified, that may be required and/or requested at any given time in order to complete the work, will be charged upon invoicing.

 

“The Company” reserve the right to charge as quoted where applicable, and also reserve the right to charge rates for services rendered as of the current pricing schedule set by “The Company”, (a current schedule of rates can be provided upon request), and for materials supplied/used and/or installed.  For un-quoted services, a minimum first hour call out fee applies upon arrival which includes one full hour of service irrespective of services rendered with an hourly pro-rata rate chargeable for each subsequent 15 minutes spent on site thereafter to service the initial purpose of the call out. Call out fees and subsequent hourly rates are subject to the current pricing schedules for Plumbing work (and/or drain cleaning work rates where the use of specialised equipment is required in addition to regular tools of trade).  Where applicable, any cost for other “heavy” plant and/or equipment that may be required to complete the work, ie: Earth moving or access equipment, will be charged upon invoicing. All rates, or cost of goods and/or services, are chargeable upon arrival on site, whilst onsite and until the completion of service which may include travel to acquire additional tools or materials to complete the intended works.  For booking cancellations “The Company” requires a minimum 1 hour of notice, failing this may attract an administration/travel fee chargeable at “The Company’s” discretion.

 

Credit/Payment & Invoicing Terms:

 

Invoices issued at the completion of service are payable upon the completion of service unless otherwise approved for account credit terms.  Account credit/Invoicing terms shall be approved upon the discretion of “The Company”.

 

For account credit terms, invoices will be issued either at the completion of service or at a later time.

 

Account credit payment terms are strictly 7 days from date of invoice.  Should payment not be received within 14 days a statement and/or reminder will be raised and issued to the invoice recipient.  At the discretion of “The Company”, accounts exceeding 30 days may be referred to debt recovery and collection.

 

Defaulting payment by the due date, “The Company” may, without prejudice:

          i.      Charge for all losses, liabilities, costs and expenses, including but not limited to, debt recovery and legal expenses including commission charged by debt recovery agents and solicitor’s costs on a full indemnity basis.

         ii.      Cease or suspend supply of any further labour and/or goods.

       iii.      By notice in writing to the “Client”, terminate any contract so far as unperformed by the “Company”. 

 

All persons and/or entities which has engaged our services acknowledges and accepts “The Company’s” services, trading, credit and payment terms as specified within this service document.
